Terms & Conditions

These Terms govern your access to and use of Destination Hub. Please read them carefully โ€” they protect both you and us.

  • โ€ขThese Terms & Conditions constitute a legally binding agreement between you and Destination Hub.
  • โ€ขBy accessing or using the Platform โ€” on any device or channel โ€” you confirm you have read, understood, and agreed to these Terms.
  • โ€ขIf you do not agree, you must immediately discontinue use and may request account deletion.
  • โ€ขThese Terms apply to the Destination Hub website, Android application, and iOS application.

Agreement to Terms

These Terms and Conditions ("Terms", "Agreement") are entered into between you ("User", "you", "your") and Destination Hub ("Destination Hub Team", "we", "us", "our") and govern your access to and use of the Destination Hub learning management system, including all related websites, mobile applications (Android and iOS), features, content, and services (collectively, the "Platform" or "Services").

By creating an account, logging in, clicking "I Agree", downloading our mobile application, or otherwise accessing or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Platform on behalf of an educational institution, organization, or employer ("Institution"), you represent that you have the authority to bind that entity to these Terms, and references to "you" include both you individually and such entity.

  • โ€ขThese Terms constitute a legally binding contract. If you do not agree, do not use the Platform.
  • โ€ขContinued use of the Platform following any updates to these Terms constitutes acceptance of the revised Terms.
  • โ€ขYou may not use the Services if you are prohibited from doing so under applicable law.

Definitions

The following terms, when used with capital letters in this Agreement, have the meanings set out below:

User ContentContent submitted, uploaded, or created by Users on or through the Platform
AccountThe registered profile and credentials created by a User to access the Platform
Attendance SessionA time-limited, institution-authorized event during which location is used to verify student presence
Personal DataAny information relating to an identified or identifiable natural person, as defined under applicable data protection law

Eligibility

To register for and use the Platform, you must meet all of the following eligibility requirements:

  • You must be at least 13 years of age. If you are between 13 and 18 years of age, you may only use the Platform with the prior consent of a parent or legal guardian.
  • You must have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
  • You must not be prohibited from accessing or using the Services under any applicable laws or regulations.
  • You must provide accurate, truthful, and complete registration information.
  • If registering as or on behalf of an Institution, you must have the authority to bind that Institution to these Terms.

๐Ÿ”žAge & Parental Consent

  • โ€ขUsers under 13 years of age are not permitted to use the Platform without verified parental consent.
  • โ€ขIf we discover a user under 13 has registered without parental consent, we will immediately suspend the account and delete associated data.
  • โ€ขParents or guardians who believe a child has registered without consent should contact us immediately at destinationhub1.in@gmail.com

Account Registration & Responsibilities

To access certain features of the Platform, you must create an Account. You may do so using a valid email address or by authenticating through a supported third-party provider (currently, Google).

4.1 Registration Requirements

  • You must provide your full name, a valid email address, and a profile photo (retrieved automatically via Google OAuth)
  • All registration information must be accurate, current, and complete
  • You must promptly update your Account information if any details change
  • You may not impersonate another person, use a false identity, or create an Account on behalf of someone else without authorization
  • Each person may maintain only one Account unless expressly authorized by us

4.2 Account Security

  • You are solely responsible for maintaining the confidentiality of your Account credentials
  • You must not share your login credentials, session tokens, or Account access with any third party
  • You must notify us immediately at destinationhub1.in@gmail.com upon becoming aware of any unauthorized access to your Account
  • We are not liable for any loss or damage arising from your failure to maintain Account security
  • We reserve the right to require password resets or impose additional verification steps if we suspect Account compromise

4.3 Account Accuracy

You agree to provide and maintain accurate, up-to-date, and complete information. Providing false information, registering under a false identity, or creating duplicate accounts to circumvent restrictions may result in immediate suspension or termination of your Account without notice.

Acceptable Use Policy

You agree to use the Platform solely for its intended educational purposes and in compliance with all applicable laws and regulations. You are responsible for all activity that occurs through your Account.

5.1 Permitted Uses

  • Accessing and engaging with educational content assigned or made available to you
  • Participating in assessments, tests, and quizzes within the parameters set by your Institution or instructor
  • Using attendance features to check in to authorized sessions
  • Communicating with instructors and peers through platform-provided communication tools
  • Downloading or saving content where expressly permitted by your Institution or instructor

5.2 User Conduct Standards

While using the Platform, you agree to:

  • Treat all other users, instructors, and staff with respect and professionalism
  • Use the Platform only for lawful, educational purposes
  • Maintain the accuracy and integrity of all submissions and responses
  • Comply with all rules, policies, and guidelines set by your Institution
  • Take responsibility for the security of your device and internet connection

Prohibited Activities

The following activities are strictly prohibited on or in connection with the Platform. Violation of this Section may result in immediate suspension or permanent termination of your Account, and may be reported to your Institution or relevant authorities.

Using GPS spoofing tools, VPNs, or any method to falsify your location during attendance verification

Using bots, scripts, or automated tools to access, scrape, or interact with the Platform

Engaging in any abusive, discriminatory, threatening, or harassing behavior toward any user or staff member

Commercial Misuse

Using the Platform for unauthorized commercial purposes, advertising, or solicitation of any kind

  • Attempting to reverse-engineer, decompile, or disassemble any part of the Platform software
  • Circumventing or disabling any security, authentication, or access control measures
  • Using the Platform to collect, harvest, or process other users' personal data without authorization
  • Creating false reviews, ratings, or misleading reports about instructors, courses, or Institutions
  • Facilitating, aiding, or abetting any person in engaging in the above-prohibited activities

Academic Honesty & Anti-Cheating Policy

The integrity of academic assessments is fundamental to the purpose of Destination Hub. We maintain a strict zero-tolerance policy toward cheating, academic fraud, and dishonest conduct in any form.

7.1 Prohibited Academic Conduct

  • Accessing unauthorized materials, websites, or resources during a test or examination
  • Sharing, distributing, or receiving exam questions, answers, or content before, during, or after an assessment
  • Using AI-generation tools, answer bots, or any automated assistance during assessments unless explicitly permitted
  • Colluding with another student to coordinate responses or share answers during an assessment
  • Submitting another person's work as your own, or allowing another person to complete an assessment on your behalf
  • Attempting to access or modify assessment systems, databases, or scoring mechanisms

7.2 Attendance Fraud

  • Falsifying your location to trigger attendance marking when you are not physically present
  • Asking or allowing another individual to mark attendance on your behalf
  • Using location spoofing, VPN, or GPS manipulation tools during an attendance session
  • Submitting fraudulent attendance records through any technical or manual means

7.3 Consequences of Academic Misconduct

  • โ€ขImmediate invalidation of the affected assessment or attendance session
  • โ€ขTemporary or permanent suspension of your Account
  • โ€ขNotification to your Institution and relevant academic authority
  • โ€ขReferral to appropriate legal or regulatory authorities where applicable
  • โ€ขPermanent record of the misconduct on your Platform activity log, accessible to authorized institutional administrators

We reserve the right to implement technical monitoring measures proportionate to the security requirements of individual assessments, in accordance with our Privacy Policy. Any such measures will be disclosed to Users prior to the relevant assessment.

Attendance Verification & Location Permission

8.1 How Location-Based Attendance Works

Destination Hub offers an optional automatic attendance verification feature that uses your device's location to confirm physical presence at a registered institution during an authorized Attendance Session.

  • The Platform checks whether you are within a pre-defined geofence radius of approximately 20โ€“30 meters from the registered institution's coordinates
  • Location access is triggered only during an active, instructor-initiated Attendance Session โ€” it is never accessed passively or in the background
  • Your precise location coordinates are used solely for the proximity check and are not stored after the verification is complete
  • Location data is never shared with third parties, used for advertising, or retained for any purpose other than the immediate verification event

8.2 Location Permission Is Optional

๐Ÿ“Location Permission โ€” Your Choice

  • โ€ขGranting location permission is voluntary. You are never required to enable location access to use the Platform generally.
  • โ€ขHowever, if location permission is denied, the automatic attendance feature will not function. Your instructor or Institution may need to mark attendance manually.
  • โ€ขYou may grant or revoke location permission at any time via your device's Settings. Revoking location access will disable the attendance feature without affecting your other Platform access.
  • โ€ขOn iOS, location access is requested as 'While Using the App' only. We do not request Always-On or background location access.

8.3 User Responsibilities for Attendance

  • You are responsible for ensuring your device has an active internet connection and GPS functionality during Attendance Sessions
  • Destination Hub is not liable for failed attendance checks caused by device malfunctions, GPS signal issues, or internet connectivity problems
  • Any dispute regarding an attendance record must be raised with your instructor or Institution directly
  • Attempting to manipulate, spoof, or falsify attendance is a serious violation subject to the consequences described in Section 7

Leaderboard & Privacy Protections

The Destination Hub leaderboard is an optional motivational feature designed to encourage healthy academic competition. We build privacy into this feature by design.

  • Your real name, email address, and profile picture are displayed on any public leaderboard
  • Leaderboards are used solely for motivational and educational competition purposes โ€” never for advertising, ranking for employment, or commercial purposes
  • You have no obligation to participate in leaderboard features; participation does not affect your core Platform access

Intellectual Property Rights

10.1 Platform Content

All content on the Platform โ€” including but not limited to course materials, test questions, answer keys, PDFs, video lectures, written notes, graphics, design elements, software code, logos, trademarks, and user interface elements (collectively, "Platform Content") โ€” is the exclusive property of Destination Hub or its licensed content contributors, and is protected by copyright, trademark, and other applicable intellectual property laws.

You agree that you will NOT:

  • Copy, reproduce, duplicate, or download Platform Content except as expressly permitted
  • Distribute, publish, broadcast, or publicly display Platform Content without prior written authorization
  • Modify, adapt, translate, or create derivative works based on Platform Content
  • Sell, license, sublicense, or commercially exploit Platform Content in any form
  • Remove, alter, or obscure any copyright, trademark, or proprietary rights notices
  • Share test questions, exam papers, or assessment content outside the Platform

10.2 Limited License to Users

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform Content solely for your personal, non-commercial educational purposes. This license does not constitute a sale or transfer of any ownership rights.

10.3 Institution Content

Content uploaded or created by Institutions (e.g., custom course materials, exam papers) remains the intellectual property of the respective Institution. Destination Hub is granted a limited license to host, display, and deliver such content solely for the purpose of providing the Services to that Institution's authorized users.

User-Generated Content

To the extent the Platform allows Users to submit, post, or upload content โ€” such as answers, comments, forum posts, or profile information โ€” the following terms apply.

11.1 Your Ownership & License Grant

You retain all ownership rights to User Content you create. By submitting User Content to the Platform, you grant Destination Hub a non-exclusive, worldwide, royalty-free license to store, display, and deliver that content solely for the purpose of operating and providing the Services.

11.2 Content Standards

You represent and warrant that all User Content you submit:

  • Is accurate and not misleading
  • Does not infringe the intellectual property, privacy, or other rights of any third party
  • Does not contain offensive, abusive, defamatory, or illegal material
  • Does not contain malware, viruses, or any harmful code
  • Complies with all applicable laws and regulations

11.3 Content Removal

We reserve the right โ€” but not the obligation โ€” to review, remove, or disable access to any User Content at our sole discretion, without notice, if we believe it violates these Terms, applicable law, or our community standards.

Third-Party Authentication (Google Login)

Destination Hub currently supports authentication via Google OAuth 2.0 ("Google Sign-In"). By using Google Sign-In, you authorize us to access and use certain information from your Google Account, as described in our Privacy Policy.

  • We receive only your full name, email address, and profile picture URL from Google โ€” no other Google services or data
  • We do not receive, store, or have access to your Google Account password
  • Your use of Google Sign-In is also governed by Google's Terms of Service and Privacy Policy
  • We are not responsible for any errors, data breaches, service interruptions, or policy changes originating from Google's services
  • If Google terminates or modifies the OAuth service, we may transition to alternative authentication methods with reasonable notice

  • โ€ขYou are solely responsible for compliance with Google's own Terms of Service.
  • โ€ขWe are not liable for any disruption, modification, or discontinuation of Google's authentication services.

Data Handling & Privacy Reference

By using the Platform, you acknowledge and agree to the collection, use, and processing of your personal data as described in our Privacy Policy, which is incorporated into these Terms by reference and available at: https://destinationhub.in/privacy-policy.

13.1 Student Data Protections

  • Student data is strictly protected and used only for educational and platform-operation purposes
  • Student data is never used for advertising, behavioral profiling, or commercial purposes
  • Institutional administrators may access aggregated, anonymized student data for educational administration only
  • Parents or guardians of students under 18 may request access, correction, or deletion of their child's data

Security Obligations

Maintaining the security of the Platform is a shared responsibility. You agree to fulfil the following security obligations while using the Platform.

14.1 User Security Responsibilities

  • Maintain the confidentiality of your Account credentials at all times
  • Use a strong, unique password for your Account (where applicable)
  • Log out of your Account after each session, particularly on shared or public devices
  • Keep your device, operating system, and the Destination Hub application updated to the latest available version
  • Immediately notify us if you suspect unauthorized access to your Account
  • Not use the Platform over unsecured public Wi-Fi networks without appropriate protection

14.2 Prohibited Security Actions

  • Attempting to probe, scan, or test the vulnerability of the Platform or any related systems
  • Attempting to breach or bypass authentication or security mechanisms
  • Intercepting, monitoring, or interfering with data transmissions to or from the Platform
  • Attempting to gain unauthorized access to servers, databases, or other back-end systems
  • Conducting or facilitating denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks

  • โ€ขWe implement TLS encryption for all data in transit and AES-256 equivalent encryption for data at rest.
  • โ€ขAccess to personal data is restricted on a strict need-to-know basis.
  • โ€ขWe maintain incident response procedures and will notify you of material breaches as required by applicable law.
  • โ€ขWe conduct periodic security reviews of our infrastructure and third-party service providers.

Institutional Accounts & Enterprise Onboarding

Destination Hub is designed to support educational institutions as they grow. The following terms apply to Institutions and their authorized administrators.

15.1 Institutional Access & Oversight

  • Institutions may access aggregated, anonymized data about their enrolled students for legitimate educational administration purposes
  • Institutional administrators may manage course assignments, attendance sessions, and assessments for enrolled students
  • Institutions acknowledge that student data is protected in accordance with our Privacy Policy and applicable law
  • Institutions are responsible for ensuring their use of the Platform complies with applicable education laws and data protection regulations

15.2 Student Monitoring Disclosure

Students are advised that their educational activities on the Platform โ€” including attendance records, assessment submissions, and course progress โ€” may be accessible to authorized personnel within their Institution for academic administration and oversight purposes. This monitoring is strictly limited to educational contexts and does not include access to personally sensitive private communications.

15.3 Future Enterprise Features

We are developing enhanced features for enterprise and institutional clients, including custom branding, advanced analytics dashboards, API integrations, and dedicated support tiers. Institutions interested in these features may contact us at destinationhub1.in@gmail.com for early access information.

Service Availability & Downtime

We strive to maintain reliable and continuous availability of the Platform. However, we make no guarantee that the Platform will be available at all times, uninterrupted, or free of errors.

  • Planned maintenance windows will be communicated in advance wherever practicable via in-app notifications or email
  • Unplanned outages due to technical issues, infrastructure failures, or third-party service disruptions may occur without prior notice
  • We are not responsible for any loss, damage, or academic consequences resulting from Platform unavailability
  • You are responsible for maintaining your own adequate internet connectivity and compatible device hardware
  • We reserve the right to modify, suspend, or discontinue any feature or the entire Platform at any time with reasonable notice

  • โ€ขYou are solely responsible for ensuring your device and internet connection are functional before beginning any time-sensitive activity (e.g., tests, attendance sessions).
  • โ€ขDestination Hub is not liable for test failures, missed attendance, or academic penalties caused by device failures, poor connectivity, or user error.
  • โ€ขWe recommend using the Platform on a stable network connection with a fully charged, updated device.

Suspension & Termination

17.1 Termination by You

You may terminate your Account at any time by submitting an account deletion request as described in our Privacy Policy. Termination will result in the permanent deletion of your personal data in accordance with our data retention schedule.

17.2 Suspension or Termination by Us

We reserve the right to suspend, restrict, or permanently terminate your Account and access to the Platform, with or without prior notice, if we reasonably believe:

  • You have violated any provision of these Terms
  • You have engaged in or facilitated cheating, academic fraud, attendance fraud, or any form of academic misconduct
  • You have engaged in any prohibited activity described in Section 6
  • Your Account has been compromised and poses a security risk
  • Continuation of your Account poses a legal, regulatory, or reputational risk to Destination Hub or other users
  • You have provided false or materially inaccurate registration information

17.3 Effects of Termination

  • Your access to all Platform features and Content will be immediately revoked
  • Any pending assessment results or progress records may be retained for institutional record-keeping purposes in accordance with applicable law
  • Your personal data will be handled in accordance with our Privacy Policy and applicable data retention obligations
  • Provisions of these Terms that by their nature should survive termination โ€” including intellectual property, limitation of liability, indemnification, and governing law โ€” shall survive

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM AND ALL SERVICES, CONTENT, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

We specifically disclaim all warranties including, without limitation:

  • Any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement
  • Any warranty that the Platform will be uninterrupted, timely, secure, or error-free
  • Any warranty regarding the accuracy, reliability, completeness, or timeliness of any content, information, or results provided through the Platform
  • Any warranty that defects or errors in the Platform will be corrected
  • Any warranty regarding the suitability or accuracy of educational content provided by Institutions or instructors

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply only to the fullest extent permitted by applicable law.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DESTINATION HUB AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY.

19.1 Specific Exclusions

Without limiting the above, we are not responsible for:

  • Loss or corruption of data caused by user actions, device failure, or connectivity issues
  • Academic penalties, missed deadlines, or test failures caused by Platform unavailability or technical issues
  • Incorrect or incomplete information provided by Institutions, instructors, or other users
  • Unauthorized access to your Account resulting from your failure to maintain secure credentials
  • Any decisions made by Institutions or instructors based on data provided through the Platform
  • Loss of opportunity, reputation, or revenue arising from your use of or inability to use the Platform

Liability Cap

To the maximum extent permitted by applicable law, our total aggregate liability for any claims arising out of or relating to these Terms or the Platform shall not exceed the greater of: (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) INR 500 (or equivalent in your local currency).

This limitation applies to all forms of liability, including contract, tort (including negligence), strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Where applicable law does not allow certain limitations, this section shall apply only to the maximum extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Destination Hub and its directors, officers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Platform
  • Your breach of any provision of these Terms
  • Your violation of any applicable law or regulation
  • Any User Content you submit to the Platform
  • Your infringement of any third-party intellectual property, privacy, or other rights
  • Any academic misconduct, fraud, or misuse of the Platform attributable to you

Modifications to Services

We are continuously working to improve Destination Hub. We reserve the right to modify, update, suspend, or discontinue any feature, functionality, or component of the Platform at any time.

  • New features or improvements may be added to the Platform at any time without prior notice
  • Existing features may be modified, limited, or removed, with reasonable notice provided where practicable
  • We may retire or discontinue specific features (e.g., specific assessment formats) with advance notice via in-app communication or email
  • We are not liable for any impact on your educational experience resulting from permissible modifications to the Platform

Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will use commercially reasonable efforts to notify you of material changes in advance.

  • Material changes will be communicated via prominent in-app notice and/or email to your registered address at least 15 days before the change takes effect
  • Minor clarifications will be reflected by updating the 'Last Updated' date at the top of this document
  • Continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Terms
  • If you do not agree to any revised Terms, you must discontinue use and may request account deletion

Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Subject to the dispute resolution process below, you and Destination Hub agree to submit to the exclusive jurisdiction of the courts located in Andal, West Bengal, India for the resolution of any disputes arising under or in connection with these Terms.

23.1 Dispute Resolution

  • Before initiating any formal legal proceedings, the parties agree to attempt to resolve any dispute informally by contacting us at destinationhub1.in@gmail.com
  • We will endeavor to respond to all informal dispute notices within 30 days
  • If the dispute cannot be resolved informally within 60 days, either party may pursue formal legal remedies

Miscellaneous Provisions

24.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional guidelines or policies incorporated by reference, constitute the entire agreement between you and Destination Hub regarding the Platform and supersede all prior agreements, understandings, or representations.

24.2 Severability
